21 Feb 2011 Article 101(1) of the Treaty on the Functioning of the European Union (TFEU) (ex-Article 81(1) of the Treaty Establishing the European Community (TEC)) prohibits all agreements between undertakings, decisions by associations of undertakings and concerted practices which may affect trade between European Union (EU)
The purpose of these guidelines is to provide guidance on the application of the TTBER as well as on the application of Article 101 of the Treaty on the Functioning of the European Union ('the Treaty') to technology transfer agreements that fall outside the scope of the TTBER.
