I can also confirm that you can steal Gungnir from Odin. You absolutely NEED your thief to be at lvl.71 or above to do it. I tried at least a dozen times with my thief around lvl.40-50 and kept getting nothing but elixirs, but managed to get Gungnir on my third try once I hit lvl.75.
