Mar 21, 2014 In 2012 Bennett & Co implemented an information barrier policy based on applicable Law Society of New South Wales and the Law Society of Victoria guidelines. The policy was explained in detail to all of Bennett & Co's solicitors, research clerks, secretaries and support staff at compulsory seminars during
barrier. The Law Society of New South Wales in consultation with the Law Institute of Victoria has developed guidelines on information barriers.23 The guidelines do not purport to outline the steps that are either necessary or sufficient to create an effective information barrier. This isbecause the nature and sophistication of
information barriers. An information barrier, properly constructed taking into account the issues set out in these guidelines, is an important element in ensuring that the duty of confidentiality is maintained and allowing a law . In New South Wales and Victoria, this is reflected in Rule 10 of the Legal Profession Uniform.
The information barrier will comply with the requirements of the Information Barrier Guidelines produced by the Law Institute of Victoria. These guidelines are provided for the guidance of solicitors . They are, however, merely a precis of the full “Information Barrier Guidelines" (20 April 2006). Law practices should familiarise themselves with the full Guidelines before attempting to implement effective information barriers into the law practice.
